Wendy Thomas concentrates her practice on professional liability, business, securities, intellectual property, class action, and labor and employment litigation. Wendy has first-chaired more than fifteen trials to conclusion, and has accrued invaluable experience in litigating hundreds of cases across her various practice areas.

Prior to entering private practice, Wendy worked as a federal prosecutor at the U.S. Attorney’s Office in the Northern District of California, specializing in white collar, environmental and immigration crimes, where she handled a variety of cases through every phase of prosecution, including grand jury, motion practice, trial, sentencing, and appeal. Wendy also worked as a white collar prosecutor in New York City specializing in identity theft, cybercrime, racketeering, insurance fraud, and copyright and trademark offenses. Wendy has also conducted regulatory investigations of financial services, health care, and construction companies.

Representative Cases

  • Secured dismissal of federal lawsuit filed against law firm at the pleadings stage with no money paid by the client or carrier.
  • Defended law firm against multi-million dollar legal malpractice claims arising from alleged conflict of interest and discovery violations following a fact-intensive trial.
  • Defended law firm against legal malpractice claims following multi-million dollar trial verdict in underlying case.
  • Represented lawyer threatened with referral to disciplinary proceedings.
  • Defended lawyer against legal malpractice claims related to establishment and funding of a family trust.
  • Defended a publicly traded company against misappropriation of trade secrets and corporate raiding claims brought by a multinational conglomerate related to call-center activities in the Philippines, and obtained a complete dismissal with prejudice and full release of the client with no money paid by the client after almost four years of litigation.
  • Won arbitration involving shareholder dispute of closely held corporation by successfully petitioning to restore shareholder rights of an individual shareholder and secured multi-million dollar settlement for shareholder.
  • Defended a publicly traded company against alter ego and fraudulent conveyance claims brought in a breach of lease case and obtained a favorable settlement – less than 5% of the damages initially sought by the plaintiff, which was a lower amount than had been offered at the inception of litigation.
  • Defended award of tens of millions of dollars in attorney’s fees that resulted from over sixty class action lawsuits brought pursuant to the Truth In Lending Act against various financial institutions.
  • Defended interior design company against trademark claims brought by the Rothschild family and obtained a complete dismissal with prejudice of all claims with no money paid by the client and without sacrifice of any intellectual property rights.
  • Defended law firm against tortious interference, misappropriation of trade secrets, and quantum meruit claims and secured seven figure settlement for client.
  • Defended the largest provider of midway entertainment in North America in a lawsuit filed by the State of Michigan that sought a million dollars in damages against client.  Countersued the State of Michigan and ultimately obtained a complete dismissal of the State’s case as well as monetary damages against the State and even reinstatement of the client’s contractual rights, and also successfully moved to compel the deposition of the Governor of the State of Michigan, becoming one of the only attorneys in the history of the United States to obtain a court order commanding a sitting governor to be deposed.
  • Conducted jury trial in Los Angeles Superior Court in Wilshire Boulevard high-rise property dispute related to flooding damage, environmental contamination and remediation.
  • Successfully defended an award of attorney’s fees on appeal following a multi-million dollar jury trial verdict.
  • Arbitrated a $40 million negligent design and construction dispute related to one of the largest personal residences in the United States.
